JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Raniganj P.S. Case No. 29 of 2019, registered for offences punishable under Sections 20/22 and 24 of the NDPS Act. Allegation is of recovery of 60 kg of ganja from honda city vehicle.
Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been made accused in this case and the driver of the car who succeeded in fleeing away, later on arrested and he disclosed that the ganja belonged to Birendra Yadav and Arvind Yadav and not of the petitioner and except that there is nothing against the petitioner and he has been implicated at the instance of his own employee with whom the petitioner has some controversy with regard to payment of wages and further he has
Patna High Court CR. MISC. No.25568 of 2019(3) dt.22-05-2019 2/2 been in judicial custody for last four months and chargesheet has been submitted.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge NDPS, Act, Araria, District - Araria, in connection with Raniganj P.S. Case No. 29 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
