The writ application has been filed seeking a direction to depute a Magistrate for the purpose of construction of boundary wall by the petitioner.

Learned counsel for the State is present and has filed counter affidavit on behalf of respondents no. 2 to 4. In the said, the stand is that upon enquiry it has been found that the land on which the petitioner wants to construct the boundary wall is disputed between the petitioner and another private person. In view of there being dispute, inter alia, between the private parties, the Court does not find it appropriate to interfere

Patna High Court CWJC No.13415 of 2014 dt.14-02-2017 2/2 in the matter.

In view thereof, the writ petition stands disposed off both on account of non-prosecution as well as on merits. It goes without saying that the petitioner shall be at liberty to move the appropriate forum, in accordance with law, for redressal of his grievance.
