ANJANA MISHRA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Motihari Mufassil P.S. Case No.174 of 2015 for allegedly having committed the offences under Sections 341, 323, 307, 384/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the entire allegation against the petitioners is false and has been occasioned on account of previous enmity between the parties. Earlier also another case, bearing Muffasil P.S. Case No. 138 of 2015, was lodged against these two petitioners for demanding Rangdari whereas the Petitioner No.1 had filed

Patna High Court Cr.Misc. No.50035 of 2016 (3) dt.11-01-2017 2/2 Motihari Mufassil P.S. Case No.173 of 2015 against the informant.

Considering the fact that there is a case and counter case between the parties and also the nature of allegations made against them, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Mufassil P.S. Case No.174 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
