The petitioners have been in custody since 09.03.2019 in connection with C2-104 of 2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioners submits that the allegation is of recovery of 1526 bottles of Nepali Saufi Wine. The alleged recoveries were not made from the conscious possession of the present petitioners and the seizure-list does not indicate their signatures. He thus submits that the petitioners are having no criminal antecedent and may be extended the
