The petitioner prays for grant of anticipatory bail in Complaint Case No. 219C 2 of 2016 registered under Section 47(A) of the Excise (Amendment) Act, 2016.

It has been submitted that actually, the recovery was made from open field and not from the conscious possession of the petitioner.

In my view, the petitioner should surrender and pray for grant of bail which shall be considered on its own merit unprejudiced by the present order.

Accordingly, the application for anticipatory bail is disposed of.
