The petitioner seeks bail in a case registered for the offence punishable under Sections 385, 392 of the Indian Penal Code.
Allegation is that unknown miscreants snatched the bag containing Rs. 1,82,000/- of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.01.2020. Charge-sheet has been submitted in this case. There is no allegation of tampering
Patna High Court CR. MISC. No.23662 of 2020(2) dt.16-09-2020 2/2 of the witnesses alleged against the petitioner. The petitioner is not named in the FIR. No incriminating article has been recovered from the possession of the petitioner and the petitioner has not been put on TIP. He further submits that similarly situated co-accused have been granted bail by coordinate Benches of this Court in Cr. Misc. No. 30961 of 2019 on 10.05.2019, in Cr. Misc. No. 52687 of 2018 on 30.08.2018 and in Cr. Misc. No. 33087 of 2018 on 07.06.2018. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Gadhpura Police Station Case No. 05 of 2018.
