ANJANA MISHRA ORAL ORDER 16-05-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Rupaspur P.S. Case No. 18 of 2014 registered for the offences punishable under Sections 420, 406 of the Indian Penal Code and Section 135 N.I. Act.
Learned counsel for the petitioner submits that there was an agreement for sale and purchase of land between the parties. So far as the present petitioner is concerned, she is the wife of Arvind Kumar, who is alleged to have entered into an
Patna High Court Cr.Misc. No.57455 of 2015 (5) dt.16-05-2016 2/2 agreement with Opposite Party No. 2 after accepting Rs. twenty lakhs, as consideration amount for a piece of land situated at Danapur. Learned counsel for the petitioner submits that there is not a single chit of paper against the present petitioner to indicate the signature on the agreement paper or had signed any of the cheques, which subsequently could not be encashed for one reason or the other.
In view of the aforementioned facts and circumstances of the case, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur (Patna) in connection with Rupaspur P.S. Case No. 18 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) ajaypd./- U T
