JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Jale P.S. Case No. 180 of 2018, registered for offences punishable under Sections 302, 498A, 201/34 of the Indian Penal Code.

Petitioners happen to be mother in law and father in law of the deceased and allegation against them and others is of torture and brutally assaulting the deceased causing her death. It has been submitted on behalf of the petitioners that no specific allegation has been attributed to the petitioners, who are mother in law and father in law and the case is not under Section 304(B) and the husband of the deceased is also in judicial custody and as a matter of fact husband of the deceased

Patna High Court CR. MISC. No.25287 of 2019(3) dt.22-05-2019 2/2 had illicit relationship with another lady and due to which, there was dispute between the deceased and her husband and the petitioners have no role to play in the death of the deceased. Further submission is that petitioners have been in judicial custody since 07.12.2018.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Jale P.S. Case No. 180 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
