The petitioner seeks bail in connection with S.T. No. 53 of 2021 arising out of Katihar Town P.S. Case No. 317 of 2020 registered for the offence punishable under Sections 326/307/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The petitioner's prayer for bail was earlier rejected on 23.08.2021 in Cr. Misc. No. 13070 of 2021. Thereafter the petitioner has again moved this Court in Cr. Misc. No. 10626 of 2022, which was withdrawn on 30.03.2022.

As per the report dated 05.07.2022, five out of seven chargesheeted witnesses have been examined. In terms of the report, only two witnesses remained to be examined. Having regard to the advanced stage of the trial, this Court would consider it appropriate that the matter be concluded

The petition is rejected.
