The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 324, 307, 504, 506/34 of the Indian Penal Code and later on Section 302/34 of the Indian Penal Code was added.

It is alleged that the informant went out from the house to ease out, then Md. Salim caught hold of her by catching her hairlock and caused injury with knife. Md. Salim was being instigated by the second wife of her husband Gulesha, petitioner Nazra Khatoon and motherin-law Samidan Khatoon. It is submitted by the learned counsel for the petitioner that Md. Salim is the brother-in-law of the informant

Patna High Court Cr.Misc. No.56111 of 2015 (2) dt.10-12-2015 whereas the petitioner is brother's wife of the husband of the informant. Accusation of assault is not specific against the petitioner.

Considering the specific accusation of assault is against Md. Salim, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Katihar in connection with Kadwa (Balia Belone) P.S. Case No. 141 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
