2. The petitioner has preferred this application for grant of regular bail in connection with Kamtaul P.S. Case No. 8 of 2024 dated 10.01.2024 registered for the offences punishable under Section 395 and 397 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the informant alleges that the petitioner and the co-accused persons along with 5-6 unknown miscreants came on motorcycle surrounded the informant and abused and the co-accused Chandan Yadav assaulted the informant by an iron rod on his head but when the informant tried to save himself then he sustain injury near his

No.25512 of 2025(2) dt.05-05-2025 2/3 left eye due to which he fell down on the ground, thereafter, the co-accused, Durgesh Mishra and Pankaj Chaupal wrapped towel around his neck and tried to strangulate him and the petitioner snatched Rs. 40,000/- from his pocket of the informant. When the informant shouted, nearby villagers came there to save him then the co-accused, Chandan Yadav fired on them by his pistol and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has been sprung up in this case on mere suspicion. There is no specific allegation against the petitioner rather the specific allegation of assault by an iron rod is against the co-accused Chandan Yadav. There is general and omnibus allegation against the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has eight criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 30.01.2024. The co-accused person has already been granted anticipatory bail by the Co-ordinate Bench vide order dated 08.07.2024 passed in Cr. Misc. No. 38074 of 2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Darbhanga in connection with Kamtaul P.S. Case No. 8 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
