Criminal Miscellaneous No.49302 of 2016 Arising Out of PS.Case No. -284 Year- 2016 Thana -BEGUSARAI MUFFASIL DistrictBEGUSARAI ======================================================
1. Banti Ram, Son of Late Surendra Ram, Resident of Village- Paharigachi, P.S.- Muffasil, District- Begusarai .... Petitioner
Versus
1. The State of Bihar .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Surendra Kishore Thakur, Adv. For the Opposite Party : Mr. Ganesh Prasad Singh, APP 198 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2016 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of anticipatory bail for offence under Sections 324 of 307 of the Indian Penal Code. Allegation against the petitioner is that he caused the injury on the head of the informant.
Submission is that the parties have compromised the case.
Considering the nature of allegation against the petitioner, I am of view that this is not a fit case for grant of anticipatory bail.
However, the Court below in the event of surrender of the petitioner shall dispose of the prayer for regular bail without being prejudiced of this order, on the day of surrender itself. With this observation, this application stands disposed of.
