JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Jehanabad P.S. Case no. 237 of 2017, registered under Sections 406, 420, 504 and 506/34 of the Indian Penal Code and Section 138 of the N.I. Act.

The accusation is that petitioners induced the informant to invest money in his construction work, accordingly, informant came in touch with the petitioners and gave Rs. 13,60,000/- and agreement was also prepared later on their persuasion the informant gave Rs. 15 Lakhs as security for transport business, while Rs. 8,50,000/- was paid to the informant, but remaining amount was not paid. Thereafter, cheque of Rs. 45 Lakhs was handed over to the informant, but on

Patna High Court Cr.Misc. No.36040 of 2017 (3) dt.12-12-2017 2/2 presentation the same was dishonoured.

Learned counsel for the petitioners submits that, in fact, there was business relation in between Muninder Kumar, son of the petitioners and the informant and Muninder Kumar issued cheque of Rs. 45 Lakhs, which is said to be dishonoured and the petitioners being the parents of Muninder Kumar have falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with jehanabad P.S. Case No. 237 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
