JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Petitioner being husband of the complainant is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demand. The basic accusation is of torture for nonfulfillment of dowry demand. The marriage between the petitioner and the complainant is an admitted fact.
The matter was adjourned on the ground of submission of learned counsel for the petitioner to the effect that the petitioner is ready to keep the complainant with dignity and honour. Though, he refused to resume the conjugal life with the
Patna High Court Cr.Misc. No.22238 of 2015 (5) dt.08-12-2015 2/2 complainant before the learned court below. But, today learned counsel for the petitioner submits that petitioner is not in a position to keep the complainant. However, counsel for the complainant submits that the complainant is still ready to resume the conjugal life with the petitioner. Under the circumstances, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No.4138 of 2013, pending before the learned SDJM, Vaishali at Hajipur.
With the above observation, this application is, accordingly, disposed off.
