JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Maharajganj P.S. Case No. 62 of 2020 registered for the offence punishable under Sections 302/34 of the Indian Penal Code. Mr. Vikram Deo Singh, learned counsel appearing on behalf of the petitioner, appears to be correct in his submission that in similar circumstance co-accused Jawahir Yadav has been allowed regular bail by this Court by an order dated 21.10.2020, passed in Cr. Misc. No. 26917 of 2020. There is allegation against the co-accused Pradeep Yadav of having given a blow with iron rod in the head of the deceased. It is alleged that thereafter other persons including the
Patna High Court CR. MISC. No.25813 of 2020(3) dt.01-12-2020 2/2 petitioner, had assaulted the informant's father, who succumbed to the injuries. The nature of injuries sustained by the deceased, has been discussed in the order of this Court dated 21.10.2020, passed in Cr. Misc. No. 26917 of 2020. There is no distinguishable feature in the petitioner's case for the purpose of grant of regular bail in the present case for him to deny the privilege, which has been granted to Jawahir Yadav, co-accused. This application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Siwan in connection with Maharajganj P.S.
