The petitioner is apprehending arrest in connection with Sherghati P.S. Case No. 65 of 2020 for offences under Sections 379, 401, 414, 411 and 34 IPC. Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. On the disclosure made by one Golu Kumar, raid was conducted at different places including the residence of the petitioner and behind the back of the petitioner a motorcycle was seized from the residence of the petitioner. While preparing the seizure list, the mandatory provisions of Section 100 Cr.P.C. was not followed. Considering the fact that the petitioner has no criminal antecedent, the seizure list was not prepared in
Patna High Court CR. MISC. No.27668 of 2020(2) dt.26-11-2020 2/2 accordance with the provisions of Section 100 Cr.P.C. and the fact that there is no witness to the seizure list, the Court is inclined to grant anticipatory bail to the petitioner on deposit of cash of Rs. 30,000/-. Let the petitioner, above named, in the event of arrest or surrender within four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Sherghati, Gaya in connection with Sherghati P.S. Case No. 65 of 2020, subject to deposit of cash of Rs. 30,000/- and further subject to the conditions as laid down under Section 438(2) Cr. P. C.
The deposit of cash of Rs. 30,000/- shall abide by the final outcome of the present pending criminal case. (Anil Kumar Upadhyay, J) spandey/- U T
