The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 251-B)a, 26 and 35 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that three accused persons were apprehended and rest fled. It is next alleged that from the apprehended accused, firearms, cartridges, motorcycle and dagger were recovered and the apprehended accused disclosed the name of the petitioner and others who fled. The learned counsel for the petitioner submits that petitioner was not arrested from the spot. It is next submitted that his name transpired in the confessional statement of co-accused in police

Patna High Court CR. MISC. No.27808 of 2022(2) dt.14-11-2022 2/2 custody which does not have any evidentiary value. It is next submitted that at the cost of repetition that petitioner is a person with clean antecedent.

The learned Additional Public Prosecutor opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bidupur P. S. Case No.341 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. with a condition that one of the bailors of the petitioner shall be his father namely, Mishri Lal Paswan @ Mishri Paswan.

The application stands allowed.
