JUSTICE BIRENDRA KUMAR ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 409/34 of the Indian Penal Code. Allegation is that just to ensure wrongful entry in the job of contract teachers, the petitioner made interoperation in the mark-sheet of intermediate and the real marks 565 was shown as 665.

Submission of the petitioner is that the petitioner has produced original certificate and a copy of the same was made available to the authorities. All these documents show that petitioner had got 565 marks.

The further submission of the petitioner is that though

Patna High Court Cr.Misc. No.52550 of 2016 (2) dt.08-12-2016 FIR has been lodged but no proceeding has been initiated against the petitioner, during his job, for removal. It is difficult to say as to who had made over writing and cutting in the certificate. Moreover, photo copy of the original certificate is already on the record before the informant, therefore, it cannot be alleged that in the application form interpolation was made by the petitioner. Let, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal/Successor Court in connection with Kinjer Police Station Case No. 81 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
