JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Amnaur P.S. Case No. 207 of 2016 registered for the offence punishable under sections 30(a), 38 and 41 of the Bihar Excise Act, 2016. Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been implicated in this case on confessional statement of the coaccused. It is further submitted that informant and this petitioner are resident of the same village and there is admitted land dispute between the parties. Nothing has been recovered from conscious possession of this petitioner. He is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,
Patna High Court Cr.Misc. No.38563 of 2017(5) dt.30-11-2017 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge, Saran at Chapra in connection with Amnaur P.S. Case No. 207 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
