2. This modification application has been filed for extension of time for depositing the amount of Rs. 1,50,000/- in three equal installments of Rs. 50,000/- each in the Nazarat of the Civil Court mentioned in order dated 29.01.2025 passed by this Court in Criminal Miscellaneous No. 75300 of 2024.

3. Learned counsel for the petitioner submits that vide order dated 29.01.2025, the petitioner was directed to deposit Rs. 1,50,000/- in three equal installments, wherein, the first installment of Rs. 50,000/- was to be deposited by

No.29771 of 2025(2) dt.09-05-2025 2/3 the petitioner on or before 15th March, 2025 and thereafter, second and third installments of Rs. 50, 000/- each was to be deposited on or before 15th April, 2025 respectively in the Nazarat of the Civil Court, but the petitioner was not able to deposit the aforesaid amount of Rs. 1,50,000/- within the time fixed by this Court as the petitioner could not arrange the money at the relevant period due to his poor health. Though, he could have furnished his bail bond but due to some misconception he could not do so. As such, learned counsel for the petitioner prays for extension of time to deposit the said amount in the Nazarat of the Civil Court.

4. Learned counsel for the petitioner further submits that the petitioner is ready to deposit Rs. 1,00,000/- on 22nd May, 2025 followed by rest amount of Rs. 50,000/- to be deposited by 30th June, 2025 in the Nazarat of the Civil Court.

5. Considering the aforesaid facts and circumstances and averments made in the application, this modification application is allowed.

6. The order dated 29.01.2025 passed in Criminal

Patna High Court CR. MISC. No.29771 of 2025(2) dt.09-05-2025 3/3 Miscellaneous No. 75300 of 2024 stands modified to the aforesaid extent.

7. In the meantime, no coercive steps shall be taken against the petitioner.
