Petitioner apprehends arrest in connection with Ghoghardiha P.S. Case No. 42 of 2016 registered for the offence punishable under sections 147, 149, 341, 323, 354(A), 379 and 504 of the Indian Penal Code and sections 3/4 of the Dian Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to dirty village politics. The allegations levelled are general and omnibus in nature. Moreover, the injuries sustained have been found to be simple in nature. Petitioner is a man of clean antecedent.

Patna High Court CR. MISC. No.29929 of 2019(2) dt.14-05-2019 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named in the first information report and there is specific allegations levelled against him.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
