JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-11-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner seeks bail in Digha P.S. Case No. 668 of 2019 registered for the offence under Section 392 of the Indian Penal Code.

As per prosecution case, on 26-11-2019 at about 8 AM, while the informant was going with his brother on his scooty, having cash of Rs. 2,85,525/- in the dick, and reached near gate no. 81, Kurji Pul, 2-3 miscreants stopped his scooty and snatched the same and fled away.

It is submitted on behalf of petitioner that petitioner is not named in the FIR. Name of the petitioner has come on the basis of confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner

Patna High Court CR. MISC. No.27679 of 2020(3) dt.09-11-2020 2/2 and petitioner is in custody since 16-02-2020. However, learned A.P.P. for the State has vehemently opposed the bail application and submitted that during investigation, the petitioner has been seen in the CCTV footage and petitioner has also criminal antecedent, which fact has been stated in paragraph - 3 of the petition.

Considering the aforesaid facts and circumstances, the bail application of petitioner stands rejected. (Prabhat Kumar Singh, J.) anay/- U T
