The petitioner is apprehending his arrest in connection with Samastipur (Mufassil) P.S. Case No. 128 of 2021 pending in the Court of learned Additional Sessions Judge-II-cum-Special Judge Excise, Samastipur in a case registered for the offences punishable under Sections 30(a) of the Bihar Excise Prohibition Amended Act, 2016. It is a case of recovery of english wine from the motorcycle of the petitioner bearing Registration No. BR 33U5233. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He

Patna High Court CR. MISC. No.36700 of 2021(2) dt.03-03-2022 2/2 further submits that the petitioner has got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In view of the fact that the said wine was recovered from the motorcycle of which the petitioner was the owner, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
