2. The petitioners apprehend their arrest in connection with Parbatta P.S. Case No. 504 of 2024, registered for the offence punishable under Sections 352, 351(2), 87, 3(5) of the B.N.S.
3. The case of the prosecution, in short, as per the
Patna High Court CR. MISC. No.27820 of 2025(2) dt.07-05-2025 2/3 informant is that on 10-12-2024 at about 02.00 P.M. petitioners enticed and kidnapped his wife Nisha Devi (34 years) with intention to marry her. His wife took away ornaments worth Rs. 70,000/-, cash Rs. 2,00,000/- and other articles. When informant contacted with Indal Singh and asked about his wife, then Indal Singh abused him and threatened to kill.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have been falsely implicated in the present case. The FIR has been lodged after delay of 21 days for which no explanation has been given. In the Court below, the victim Nisha Devi herself appeared and stated that she left her house with her own will.
5. Learned A.P.P. for the State opposes the prayer of anticipatory bail.
6. The petitioners are said to have assisted/supported Indal Singh (co-accused) for kidnapping Nisha Devi (wife of informant, Mukesh Kumar) with intention to marry her. The wife of the informant Nisha Devi appeared before the Court below and voluntarily stated that she had left her house with her own will, meaning thereby that she had not been kidnapped. In any case, the main thrust in the FIR is against Indal Singh and not against the petitioners. The petitioners have no criminal
Patna High Court CR. MISC. No.27820 of 2025(2) dt.07-05-2025 3/3 antecedent. Under these circumstances, this Court is inclined to grant privilege of anticipatory bail to the petitioners.
7. Let the petitioners, named above, in the event of their arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Khagaria in connection with Parbatta P.S. Case No. 504 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Alok Kumar Sinha, J) kiran/- U T
