In this case, the petitioners are apprehending their arrest in connection with Gopalpur P.S. Case No. 201 of 2017 registered for offences under sections 341, 323, 324, 325, 504, 354, 307/148 of the Indian Penal Code.

In the present case, the dispute is with respect to passage/route. On that account, the petitioners party have assaulted the Informant by different weapons such as Lathi, Danda and Farsa causing injury to the Informant and have also pushed down the Informant.

There is a specific allegation against the petitioner no. 2, Sudhir Thakur to have assaulted by Farsa to Sanju Devi, daughter of the Informant.

Patna High Court Cr.Misc. No.26815 of 2018(2) dt.03-05-2018 2/2 There being direct allegation against the petitioner no.2, this Court is not inclined to grant privilege of anticipatory bail to the petitioner no.2 and, thus, the prayer for anticipatory bail of the petitioner no.2 is rejected.

Looking to the entire facts and circumstances of the case as also there being no direct allegation, let the petitioner nos. 1 & 3, namely, Ranjeet Thakur and Kamaljeet Kumar @ Kamaljeet, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge IX cum Additional Chief Judicial Magistrate, Patna in connection with Gopalpur P.S. Case No. 201 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
