JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2017 The petitioner is apprehending his arrest in connection with Jhanjharpur P.S. Case No. 131 of 2016, (corresponding to G.R. No. 1515/2016) registered for offences punishable under Sections 458, 341, 323, 332, 353, 504, 506 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner is nowhere concerned with the patient and only on the request of patient's husband, he brought the patient to the hospital, where some scuffle took place between the patient and the doctor and nurse of the said hospital on fees and petitioner was only trying to pacify the matter, for which he has been implicated in the present case.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that
Patna High Court Cr.Misc. No.944 of 2017 (2) dt.18-01-2017 2/2 petitioner is not related to the patient and only happens to be the person, who brought the patient to hospital and he has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of ACJM-I, Jhanjharpur, Madhubani in connection with Jhanjharpur P.S. Case No. 131 of 2016, (corresponding to G.R. No. 1515/2016), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
It is further subject to the condition that the petitioner shall cooperate in the investigation and make himself available as and when required by the police.
