The petitioner apprehends his arrest in connection with Barhara (Raghubansh Nagar) P.S. Case No. 265 of 2019 registered for the offences under Sections 341, 323, 504, 506, 376, 427 and 379/34 of the Indian Penal Code. Considering the fact that the petitioner is involved in the crime of outraging the modesty of a minor girl, I am not inclined to grant anticipatory bail to him. This application for anticipatory bail is dismissed.

However, it is submitted by learned counsel for the petitioner that similarly situated accused persons have been granted anticipatory and regular bail.

In case the petitioner surrenders and prays for regular bail before the court below within a period of four weeks from

Patna High Court CR. MISC. No.36900 of 2021(2) dt.17-05-2022 2/2 today, the court below will consider the petition for regular bail of the petitioner without being prejudiced by the fact that anticipatory bail petition has been dismissed by this Court. While considering the regular bail, the court below will also consider the fact that other similarly situated accused persons have been granted anticipatory and regular bail.
