The petitioner apprehends his arrest in connection with Sonepur P.S. Case No. 200 of 2017 registered for the offence(s) punishable under section(s) 341, 323, 324, 379, 307, 506, 504/34 of the Indian Penal Code.

Allegation, as per the FIR, is that on 30.05.2017, this petitioner and his family members came at the house of the informant and started abusing and this petitioner assaulted the father of the informant on his head causing injury. Allegation against the petitioner is that he assaulted the father of the informant on his head, but the injury report annexed as Annexure-3/1 to this application shows that the victim

Patna High Court Cr.Misc. No.38062 of 2017 (2) dt.17-08-2017 2/2 sustained injury on his right thigh and forearm. There is absolutely no injury on the head of the father of informant, Jay Ram Ray. Both the parties are agnates and resident of same place. A police case, vide Sonepur P.S. Case No 182 of 2006, was also lodged from the side of the petitioner against the informant and his family members and a Partition Suit No. 494 of 2004, is also pending between the parties.

Considering the omnibus allegation of assault, facts and circumstances, as stated above, this application for anticipatory bail is allowed.

Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Chapra in connection with Sonepur P.S. Case No. 200 of 2017, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code.
