====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 29-08-2025 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. This is the third regular bail application filed on behalf of the petitioner in connection with Minapur P.S. Case No. 237 of 2020, U.A.P. Case No. 2/20 registered under Sections 399, 386, 411, 120(B)/34 of the Indian Penal Code, Sections 25(1-b)a/26/35 of the Arms Act and Sections 17/18/19/20 of the U.A.P. Act. Lastly, the bail application of petitioner was rejected by this Court vide order dated 06.09.2024 passed in Cr. Misc. No. 33652 of 2023.
3. Learned counsel for the petitioner submits that the charge in this case was framed on 13.09.2024 against the
Patna High Court CR. MISC. No.33820 of 2025(5) dt.29-08-2025 2/3 accused persons including the petitioner but trial is not in progress. The petitioner shall co-operate in the trial. He is entitled to bail on the ground of delay in conclusion of trial.
4. Learned A.P.P. for the State submits that regular bail of the petitioner was earlier rejected on merit and the trial is in progress. He further submits that there is no fresh ground made out by the petitioner. The petitioner is a habitual criminal having 12 criminal antecedents of heinous crime.
5. The Trial Court Report dated 19.07.2025 reveals that out of 12 named charge-sheet witnesses, 6 witnesses have already been examined. Last witnesses were examined on 18.07.2025. The Trial Court is taking steps for conclusion of the trial at the earliest.
6. It is well settled that once the trial commences, it should be allowed to reach to its final conclusion which may either result in conviction of the accused or acquittal of the accused. However, the accused has the right to have a speedy trial.
7. Considering the nature of accusation, long criminal history of the petitioner and stage of the trial, prayer for bail of the petitioner at this stage is rejected.
8. The learned Trial Court is directed to expedite the
Patna High Court CR. MISC. No.33820 of 2025(5) dt.29-08-2025 3/3 trial and conclude the same at earliest in view of the custody period of the petitioner.
