2. Permission is granted.

3. This anticipatory bail application with regard to petitioner no. 2 is, accordingly, dismissed as withdrawn.

4. Heard learned counsel for the petitioners and the State.

5. Petitioner nos. 1, 3 & 4 apprehend arrest in a case registered for the offences punishable under Sections 115(2),

Patna High Court CR. MISC. No.28513 of 2026(2) dt.04-05-2026 2/3 126(2), 118, 303(2), 351(1), 352, 3(5) of the Bharatiya Nyaya Sanhita to which Section 109 BNS was adder later on.

6. As per F.I.R., all the named accused persons, including these petitioners, abused informant and assaulted him by means of lathi, iron rod, bamboo stick, iron chain, etc. It is further alleged that the accused persons also snatched Rs. 25,000/-.

7. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Allegation against petitioners is general and omnibus and there is no specific allegation of overt act against them. Specific accusation of assault is against co-accused Arvind Ram. Injuries sustained by the injured are simple in nature. Rest of the allegations are ornamental only to make the case grave.

8. Learned A.P.P. for the State vehemently opposed the bail application.

9. Considering the nature of accusation and injuries, this anticipatory bail is allowed with respect to petitioner nos. 1, 3 & 4 and it is ordered that let the above named petitioner nos. 1, 3 & 4 in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each

Patna High Court CR. MISC. No.28513 of 2026(2) dt.04-05-2026 3/3 with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Siwan in connection with Maharajganj P. S. Case No. 176 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

10. This pre-arrest bail application is, accordingly, disposed of.
