JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This application, for grant of anticipatory bail, arises out of Lakhisarai (Kabaiya) P.S. Case No. 146 of 2019, disclosing offences under Sections 341, 323, 353, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioners is of causing hindrance to the police in discharge of public duty, as the petitioners asked the police party to get the police vehicle out of the way and, thereafter, they assaulted the informant. Submission of learned counsel for the petitioners is that the real fact is that when the petitioners asked the informant to give way for his tractor, then, a scuffle took place between the petitioners and informant and they have falsely been implicated

Having heard both sides, in view of above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S. Case No. 146 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
