In the present case, the petitioner is claiming 2nd and 3rd M.A.C.P. as he has submitted that he has completed 30 years of service and M.A.C.P. Rule provides that the 1st M.A.C.P. will be given after completion of 10 years, 2nd after 20 years and 3rd after thirty years.

Learned counsel for the petitioner submits that the petitioner has filed a representation before the authority concerned which is pending and having been not disposed of. Let the authority concerned should consider the case of the petitioner and if he finds that the petitioner is entitled to the

Patna High Court CWJC No.25025 of 2013 dt.29-11-2017 benefit of M.A.C.P., that will be extended to him. This court is not giving any opinion on the merit of the case.

For convenience, if the petitioner files a representation before the authority concerned along with a copy of this order, he will dispose of the same within a period of four months from the date of receipt/production of a copy of this order.
