The petitioners are apprehending their arrest in connection with Chautarwa P.S. Case No.66 of 2019 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code, which is pending in the court of learned A.C.J.M.-Ist, Bagaha, West Champaran.
Pursuant to the earlier order dated 18.02.2021, a report has been received from the court that the process under Section 82 Cr.P.C. has been issued on 14.09.2020 against the petitioners. The case is pending for charge-sheet/final form. In view of the above, counsel for the petitioners
Patna High Court CR. MISC. No.27455 of 2020(7) dt.02-03-2021 2/2 submits that the petitioners would be availing their remedy of regular bail.
Considering the aforesaid submissions, this Court would only observe that the court below should consider the petitioners' prayer for regular bail without being in any manner affected by the withdrawal of this instant application and the fact that the others have already been granted bail. The application is permitted to be withdrawn with the liberty aforesaid.
This Court would expect that the petitioners' counsel would honour his undertaking in the instant proceedings regarding supply of the requisite court fee etc. within two weeks from the date he is called upon to do so by the office. (Madhuresh Prasad, J) PNM U T
