JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Amarpur P.S. Case No. 19 of 2017 registered for the offence punishable under sections 366A/34 of the Indian Penal Code to which section 376(G) I.P.C. was added later on.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. During investigation, nothing has come to suggest complicity of this petitioner in the alleged crime. As a matter of fact, petitioner runs a Readymade shop, from which mother of the victim had taken some clothes and on demand of the due amount the petitioner has been dragged in this case. Petitioner has no criminal antecedent.

Learned Addl. P.P. appearing for the State opposes the

Patna High Court Cr.Misc. No.44231 of 2017(3) dt.12-10-2017 2/2 prayer for bail and submits that there is direct and specific allegation against this petitioner of kidnapping and committing rape upon the victim.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
