JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420,406,467,468 and 471/34 of the Indian Penal Code. The prosecution case is that R.S. Plot no. 2323 pertaining to Khata No. 494 was recorded in the name of the father of the informant namely Md. Mofizuddin. On 5.6.1995 petitioner no. 1 got his name mutated in respect of 80 decimals of land out of the said plot and on 3.3.1982 petitioner no. 2 impersonated the father of the informant and executed the sale deed with regard to the land of the informant.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.56912 of 2015 (2) dt.17-12-2015 2/2 that mutation in favour of the petitioner was made in 1995 whereas the sale deed was executed in 3.3.1982 and after more than two decades the present complaint has been lodged. Considering the delayed nature of acusation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Barsoi (Kachna) P.S. Case No. 211 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
