Mr.Md. Ataur Rahman ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-07-2019 Heard learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in Bihariganj P. S. Case No. 230 of 2018 instituted for the offence under Section(s) 323, 341, 307, 354A, 379, 504 and 506/34 Indian Penal Code. Learned counsel for petitioners has submitted that these petitioners have been implicated in this case by informant only to save himself and his men from the case filed by one of the petitioner against the informant and others vide Bihariganj P.S. case no. 231 of 2018.

In the instant case, it is alleged that petitioner no.1 caused injury on the head of informant with sword whereas

The case diary has been received, wherein, the injury report is available. From perusal of the injury report it appears that doctor has found only one injury on the head i.e. lacerated wound on the scalp that has been caused by hard and blunt substance which was opined to be grievous in nature. From the injury report, it appears that there was no repetition of blow.

Petitioners are in custody since 11.1.2019.

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the CJM, Madhepura, in connection with Bihariganj P. S. Case No. 230 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioners.
