JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-10-2016 Learned counsel for the petitioner seeks permission to delete paragraph-6 as it relates to petitioner Shahanwab initially made petitioner no. 1, whose name was deleted during filing of the application.
Heard learned counsel for the petitioner and the State.
Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
The prosecution case is of using domestic gas cylinder for running the Auto rickshaw.
It is submitted by the learned counsel for the petitioner that petitioner is the owner of the auto rickshaw whereas his son use to drive the same.
Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the
Patna High Court Cr.Misc. No.46116 of 2016 (2) dt.22-10-2016 petitioner, if he surrenders before the learned court below within a period of six weeks from today in connection with Jehanabad P.S. Case No. 183 of 2016, pending in the court of learned Chief Judicial Magistrate, Jehanabad. With the above observation this application is disposed of.
