Petitioners apprehend their arrest in connection with Barh P.S. Case No. 449 of 2015 registered for offences punishable under Sections 379, 447, 506/34 of the Indian Penal Code. The prosecution case, in brief, is that on 17.10.2015 at about 1:00 A.M. these petitioners had committed theft in the grocery shop of the informant and kept the theft articles in their shop. It is further alleged in the First Information Report that earlier petitioners had told the informant that he will not be allowed to run the shop.
It has been submitted by the counsel for the
Patna High Court Cr.Misc. No.57730 of 2015 (2) dt.13-01-2016 2/2 petitioners that both, the petitioners and the informant are next door neighbour and both are owners of shops. It has further been submitted by the learned counsel for the petitioners that petitioner no.3 had lodged case against the informant, bearing Barh P.S. Case No. 101 of 2015 and the present case is a counter-blast to the previous one. Furthermore, it has been submitted that no recovery has been made from the petitioners.
Be that as it may, let petitioners, above named, in the event of their arrest or surrender before the Court below within a period of eight weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand only) each with two sureties of like amount each to the satisfaction of learned A.C.J.M., Barh, Patna in connection with Barh P.S. Case No. 449 of 2015, subject to the conditions as laid down under Section 438
(2) of the Cr. P.C.
