The petitioner apprehends his arrest in Khaira P.S. Case No.334 of 2017 registered under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

The informant alleged that Nandu Tanti, Anil Tanti, Upendra Tanti (the petitioner herein), came having armed with different weapons. Nandu Tanti inflicted knife blow on different parts of the body of Suraj, son of the informant. Another son of the informant came to save but also inflicted knife blow and assaulted with lathi by Anil Tanti and petitioner, Upendra Tanti. The learned counsel for the petitioner submits that no injury caused by hard and blunt substance was found on the person injured. There is counter version in Khaira P.S. Case No.335 of

It appears that there is omnibus allegation of assault against the petitioner. Nandu Tanti is alleged to have inflicted repeatedly on different parts including head and neck of Suraj. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No.334 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
