Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Excise P.S. Case No. 389 of 2021 arising out of Tr. No. 3110 of 2022 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 27.11.2022 and there is recovery of 18 litres of country made wine from his possession and he has two excise antecedents.

Learned APP has vehemently opposed the prayer of bail.

Patna High Court CR. MISC. No.28245 of 2023(2) dt.15-05-2023 2/2 Considering the period of custody and recovery of liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, East Champaran at Motihari in connection with Excise P.S. Case No. 389 of 2021 arising out of Tr. No. 3110 of 2022.
