09-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Sonbarsa Raj P.S. Case No. 13 of 2021, registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per the F.I.R., 10-12 accused persons including petitioner and other four known persons, armed with lathi & rod, came to the house of informant and co-accused Naresh Yadav assaulted the son of informant with axe causing cut injury and thereafter, it is alleged that this petitioner alongwith coaccused Shyam Sundar Yadav entered in the house and looted some valuable articles.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to previous enmity. There is delay of 26 days in lodging the F.I.R. and there is no

Patna High Court CR. MISC. No.36994 of 2021(2) dt.09-12-2021 2/2 plausible explanation for the same. There is no allegation of assault against this petitioner and he is in custody since 04.02.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar - VI, Judicial Magistrate, Saharsa / concerned court in connection with Sonbarsa Raj P.S. Case No. 13 of 2021.
