The petitioner is apprehending her arrest in a case registered under Sections 406, 417, 418 and 420/34 of the Indian Penal Code.

Allegation against the petitioner is that she and her husband after hatching conspiracy sold the land of one Kanchan Devi and they abused and assaulted the complainant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case.

She has been made accused because all the transactions in respect to land in question were made with the husband of the petitioner. Except for that, there is no other allegation against the petitioner. No wrongful loss or wrongful gain has been made on the part of the petitioner. The matter relates to civil dispute.

On behalf of the State, it is submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-III, Jhanjharpur, Madhubani in connection with C.R. No.661 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
