The Petitioner apprehends his arrest in Naubatpur P.S. Case No.296 of 2016 instituted for the offence under Section(s) 354/34 Indian Penal Code.
It is alleged that on the date of occurrence while the Informant was going for attending call of nature with her children, the petitioner along with Vinay Paswan, Lalita Devi and Anuj Paswan came and took her in the lap and brought her in a dark place. The Informant raised halla, then villagers arrived and they fled away.
From the written report, it appears that there is no specific allegation against the petitioner. There is general
Patna High Court Cr.Misc. No.1596 of 2017 (2) dt.18-01-2017 2/2 allegation that he along with other accused caught the Informant. There is counter case also filed by one of the accused, Lalita Devi, against the husband of the Informant and others for the offence under Section 354 Indian Penal Code.
In such circumstances, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Naubatpur P.S. Case No.296 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Danapaur, Patna, subject to the conditions as laid down under Section 438(2) Cr.
