JUSTICE BIRENDRA KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

The informant is the Bhabhi of this petitioner. Allegation is that the property was purchased by the father-in-law of the informant and all the four sons got share. However, the petitioner sold the share of the husband of the informant through registered sale deed to some other person. The matter was sent for reconciliation to the Patna High Court Mediation Centre, Patna, but the reconciliation has failed.

Considering the bona fide claim of the petitioner and nature of dispute, let the petitioner, above named, in the event of

No.40594 of 2016 (8) dt.10-02-2017 2/2 his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa/Successor Court in connection with Simri Bakhtiyarpur Police Station Case No. 69 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
