JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
The prosecution claims that petitioner along with one F.I.R. named accused were going on a motorcycle and when they were intercepted by the police, the pillion rider fled away from there throwing a bag containing 20 litres Mahua liquor and 8 bottles of Indian made foreign liquor. The petitioner was driving the motorcycle.
Submission on behalf of the petitioner is that according to prosecution case itself, the bag containing the
Patna High Court CR. MISC. No.24578 of 2019(2) dt.17-04-2019 2/2 illegal liquor was thrown by co-accused and not by the petitioner and moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 20.03.2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge V cum Special Judge, Excise Act, Munger in connection with East Colony P.S. Case No. 41 of 2019.
