The learned counsel for the petitioner submits that by order dated 10.02.2023 in Cr. Misc. No.40509 of 2022 filed on behalf of the petitioner in which the petitioner was permitted to be withdrawn the aforesaid application with a liberty to the petitioner to renew his prayer for bail after framing of charge. The learned counsel for the petitioner submits that charges against the petitioner have been framed on 02.03.2023. The learned Additional P. P. Opposes the prayer and submits that though a specific submission has been made that charges against the petitioner have been framed by order dated 02.03.2023, but then the same is not substantiated by any documentary evidence on record.
After hearing the learned counsel for the parties, the
Patna High Court CR. MISC. No.29994 of 2023(2) dt.10-05-2023 2/2 petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P. S. Case No.354 of 2019, subject to the condition that one of the bailors shall be the father of the petitioner namely, Surendar Sah @ Surendra Shah. However, the learned trial Court before accepting the bail bonds of the petitioner shall verify whether charges against the petitioner have been framed by order dated 02.03.2023 or not and in the event, if it is found that charges have not been framed, the present order shall not be acted upon.
Further, in the event, if the bail bonds of the petitioner is accepted on the ground that charges have been framed against him and thereafter, the learned trial Court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial Court shall be at liberty to forthwith cancel the bail bonds of the petitioner after recording reasons.
