2. Petitioner apprehends his arrest in connection with Deo PS Case No. 114/2022 dated 18.05.2022 registered for the offence punishable under Sections 341, 323, 325, 307, 504/34 of the IPC.

3. As per prosecution story, the petitioner has assaulted the informant by means of iron rod on his head due to which he sustained head injury. Other accused persons have also assaulted the informant by means of Lathi.

4. Learned counsel for the petitioner submits that the petitioner and other co-accused persons are full brothers of the

Patna High Court CR. MISC. No.27392 of 2023(2) dt.12-07-2023 2/2 informant. He also submits that there is a land dispute between the parties and due to which there was a free fight between them. Referring to the impugned order, learned counsel submits that the nature of the injury caused to the informant has not been brought on record by the prosecution.

Regards being had to the submissions made by the parties, taking into consideration the fact that the parties are full brothers and nature of injury caused to the informant has not been brought on record and there is a land dispute between them, I am inclined to grant anticipatory bail to the petitioners.

6. Accordingly, let the petitioner, SANJAY RAM @ SANJAY KUMAR, in the event of arrest or surrender within four weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Deo PS Case No. 114/2022, subject to the condition as laid down under Section 438(2) CrPC.
