2. The petitioner apprehends his arrest in connection with Halai P.S. Case No. 96 of 2024, registered for the offences punishable under Sections 309(4) of the BNS.

3. As per allegation, co-accused Satyendra Kumar @ Taibu along with three unknown persons, forcibly snatched the key of the truck from the khalasi, wrongfully confined him and committed theft of the truck bearing Registration No. AS01PC/3212.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that except for the confessional statement of co-accused Satyendra Kumar @ Taibu, there is nothing against him. He was neither arrested nor was any incriminating material recovered from his possession. His case stands on a better

5. On the other hand, learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJMIst, Samstipur in connection with Halai P.S. Case No. 96 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.

7. The petitioner will appear in the court on each and every date fixed by the trial court till framing of charges.
