2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 354, 379, 307, 504, 506 and 34 of the Indian Penal Code.

3. As per prosecution case, specific accusation of assault upon the informant is against co-accused Pintu Kumar. Petitioner No. 1 is alleged to have misbehaved with the wife of the informant and Petitioner No. 2 is alleged to have snatched snatched the golden Mangalsutra from the neck of wife of the informant.

4. It is submitted by learned counsel appearing on behalf of the petitioners that there is no allegation of overt act

Learned counsel further submits that as a matter of fact, over a petty dispute, a scuffle took place between the parties and in retaliation, this false and concocted case has been lodged. Petitioners claim clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts and circumstances, nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur, Patna, in connection with Shahpur P.S. Case No. 9 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
