JUSTICE SUDHIR SINGH ORAL ORDER 08-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 384, 385, 386, 504, 506 and 34 of the Indian Penal Code.
Allegation against the petitioners is that they demanded rangdari of Rs.3 lacs from the informant and on failure he would be killed.
It is submitted on behalf of the petitioners that they have been falsely implicated in the present case. The name of the petitioners has transpired in the present case on the basis of suspicion. From perusal of Annexure-2 it appears that petitioners are not named in the said case nor police has found them involved in the said case which is evident from the chargesheet submitted in Annexure-2.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.57762 of 2015 (2) dt.08-03-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri S. Ram learned Judicial Magistrate, Ist Class, Supaul, in connection with Marauna P.S. Case no. 141 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
